(“Pool Fits”), its affiliates, and/or subsidiaries (together with Pool Fits, “us”, “we”, or “our”).  This Limited Warranty / Disclaimer of Warranty, at the sole discretion of Pool Fits, may be changed at any time without prior notice.

Application – Limited Warranty / Disclaimer of Warranty

In addition to the Terms of Sale which govern your purchase of any products and services made available to you by us on or through the Site, this Limited Warranty/Disclaimer of Warranty applies to your purchase of the products or services  from us on or through the Site. By proceeding to place an order with us, you agree to be bound by this Limited Warranty/Disclaimer of Warranty. If you do not agree to this Limited Warranty/Disclaimer of Warranty, do not proceed with your order.

Some jurisdictions do not allow the limitation on implied warranties and conditions. If the laws of the state, province or territory where you reside do not allow limitation in warranties or disclaimer of warranty, some or all of this Limited Warranty/Disclaimer of Warranty herein may not apply to you.

This Limited Warranty/Disclaimer of Warranty may, at our sole discretion, be changed at any time. You are advised to review the Limited Warranty/Disclaimer of Warranty periodically for any change. Changes to the Limited Warranty/Disclaimer of Warranty are effective when they are posted on the Site.

Limited Warranty

Pool Fits warrants products to be free from defects in material and workmanship for a period of thirty (30) days from the date of shipment unless otherwise restricted below or by the respective manufacturer’s own warranty policy.

Pool Fits’ liability is limited to repairing or replacing, at its option, any defective product, with return freight prepaid to Pool Fits or its specified vendor, according to the Merchandise Return Policy & Procedures on the Site.  You shall bear all responsibility for shipping charges and risk of loss or damage during transit to Pool Fits or its specified vendor. Products which have been subjected to abuse, misuse, alteration, neglect, installation or unauthorized repair, as determined at the sole discretion of Pool Fits, are not covered by this warranty.

Any alterations, addition, improvements or attachments to any product returned to Pool Fits or its specified vendor without prior written authorization from Pool Fits shall be deemed to be a waiver of this warranty by you and shall render this warranty null and void.

Where Pool Fits has repaired or replaced products in accordance with this Limited Warranty/Disclaimer of Warranty, the repaired or replaced product shall be returned to you to the shipping address in your original order only, via regular ground service. Shipping charges by all other methods and to all destinations shall be borne by you.

THIS WARRANTY IS IN LIEU OF AND POOL FITS MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED. IN NO EVENT SHALL POOL FITS BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL OR CONTINGENT DAMAGES, SUCH AS LOSS OF USE, LOSS OF PROFIT OR BUSINESS OPPORTUNITIES AND IN NO EVENT OR INSTANCE SHALL POOL FITS’ DIRECT LIABILITY EXCEED THE PURCHASE PRICE FOR THIS SPECIFIC PRODUCT YOU HAVE ACTUALLY PAID.

Disclaimer of Warranty

The product you purchased from us may also be covered by warranties of our respective vendors or manufacturers. These vendors or manufacturers’ warranties are determined on a per product basis and materials outlining these warranties (other than those warranties implied by and incapable of exclusion, restriction or modification under applicable law) will be attached to the individual product shipped to you. Please refer to those warranty materials included with an individual product for specific vendor/manufacturer’s warranty details pertaining to your purchase.
